When asked about establishing that an apartment was a primary residence, Sherwin posited that use of the address on government documents, like a driver’s license or a voter registration, helps, stating, “Prescriptions and magazines and those things are nice, but they’re not as weighty for most judges as publicly declared documents.”
The article covers the story of a young woman seeking to remain in her family’s rent-stabilized apartment following her grandmother’s passing, claiming she lived in the unit with her grandmother for over two years. However, the building’s owner asserts that she does not meet the legal criteria to take over the rent-stabilized lease, putting her residency in question.
