In-Person Seminar: Navigating Tax Exemptions and Zoning Incentives to Maximize Impact

Join us for an in-person seminar and networking reception introducing our NEW Tax Exemptions and Zoning Incentives Department.  Our partners will share legislative insights and key planning opportunities to help property owners, developers, and investors maximize the value of their assets. The session will also include time for questions and discussion. Following the seminar, attendees will also be able to connect with our new team members and other real estate industry professionals during the networking reception.

The session will be led by Partners David Shamshovich and Jason Hershkowitz, Co-Heads of the new Tax Exemptions and Zoning Incentives Department, with support from Kara Rakowski, Co-Chair of the Administrative Law Group, and Ron Mandel, Partner in the Land Use and Zoning Group.

KEY TOPICS

  • Universal Affordability Preference (UAP): A program replacing the Voluntary Inclusionary Housing (VIH) zoning bonus in R6–R12 districts; requirements, integration with 485-x/467-m tax exemptions, and HPD’s zoning bonus application process.
  • Mandatory Inclusionary Housing (MIH): Site compliance, recent zoning text amendment rule changes, interaction with tax benefit programs (485-x/467-m), and HPD’s filing requirements before permit issuance.
  • Qualifying Residential Sites (QRS): Increased FAR opportunities in low-density (R1–R5) zoning districts, site eligibility criteria and affordability requirements.
  • Affordable Neighborhoods for New Yorkers (485-x): Affordability and construction wage requirements, key eligibility criteria, and the application process for the program.
  • Affordable Housing from Commercial Conversions (467-m): Affordability and eligibility requirements, key timing considerations, and the application process for the program.
  • Extension of Time under 421-a(16): Guidance for projects unable to complete construction by June 15, 2026, detailing necessary steps and considerations.
