In a decision this week issued by the New York Supreme Court in Eldad Prime LLC v. Gary Ostrow, D.O., P.C, Judge Adams rejected all of the Tenant’s COVID-19 defenses and counterclaims and awarded the Landlord over $1 million in damages, plus interest, costs and attorneys’ fees (referred to Special Referee). The case stemmed from a commercial tenant’s failure to pay rent soon after the Governor’s Executive Orders in response to the pandemic became effective in March 2020.
