After a non-payment eviction proceeding was initiated by another firm, the court improperly found the premises to be subject to rent stabilization. Michael Bobick and Adam Bernstein successfully reargued that the court misapplied the Rent Stabilization Law to former interim multiple dwellings (Loft Buildings) and failed to take in account that the building was substantially rehabilitated as a residential building. As such, the subject premises is no longer considered rent stabilized.
