DHCR Publishes Updated CPI and FMR Figures for Good Cause Eviction Compliance

On February 19, 2025, DHCR published (a) the updated Consumer Price Index (“CPI”) numbers and (b) Fair Market Rent (“FMR”) figures as determined by the US Department of Housing and Urban Development (“HUD”), which are to be used by owners regarding Good Cause Eviction (“GCE”).

The CPI figure relates to the  permissible rent increase (the lesser of CPI + 5%. or 10%).  The CPI number is 3.79%.  Therefore, the GCE number is 8.79%, and any increase at or below 8.79% will be deemed to be presumptively reasonable under GCE.

The HUD figures relate to the present potential exemption from GCE (245% above HUD FMR).  To determine the applicable amount consult the chart via county and apartment size.  For example, in New York County, 245% of FMR is listed on DHCR’S chart effective May 1, 2025 as:

  • Efficiency:    $5,471.00;
  • 1 Bedroom:  $5,709.00;
  • 2 Bedroom:  $6,321.00;
  • 3 Bedroom:  $7,877.00; and
  • 4 Bedroom:  $8,499.00.
