The New York State Division of Housing and Community Renewal has updated its online Individual Apartment Notification portal in connection with the changes to the Individual Apartment Improvement (“IAI”) structure that were enacted in April 2024 and became effective on October 17, 2024. The updated IAI Notification application and forms remain available exclusively on DHCR’s website through its Owner Rent Regulation Applications system.
The new IAI laws incorporate a two-tier system by which an owner of a rent stabilized apartment may be eligible for an IAI rent increase based on an increased $50,000 expenditure allowance if the apartment was (a) timely registered vacant for 2022, 2023, and 2024 registration years or (b) continuously occupied by the same tenant for at least 25 years prior to the IAI installation. The updated portal requires that an owner seeking an IAI increase under this second-tier request and obtain pre-certification from DHCR that it is eligible under one of two qualifying categories. The pre-certification process will also require an owner to submit evidence to establish that the proposed IAI will be necessary due to a substandard condition in the apartment. These documents will need to be submitted prior to commencing work on the IAI.
Unfinished IAI forms that were in process, but not yet submitted, were removed from the portal by DHCR as of 6 a.m. today as part of DHCR’s update.
