Sherwin Belkin, a Co-Founding Partner of BBG, was quoted in a Law360 article titled “Justice’s Notes on Rent Law Denials: Road Map or Dead End?”
The U.S. Supreme Court declined to review two cases challenging aspects of New York’s New York City’s 2019 Housing Stability and Tenant Protection Act (HSTPA) rent stabilization law, with Justice Thomas expressing a separate opinion that more specific cases are required to address the constitutional questions involved.
As highlighted in the article, Mr. Belkin told Law360 that “the rare statement from Justice Thomas signals the court’s desire to review the constitutional claims at the heart of both cases”. He also stated, “I think what Justice Thomas is saying is rent stabilization is something that warrants constitutional review, but in order for a case to be reviewed, rather than general claims as to constitutional infirmity, they’re looking for more specific actual empirical data.”
