A major decision by The Court of Appeals in New York ruled that a portion of New York’s rent law violates due process. The decision was over 100 pages long and is sure to have big implications to all rent overcharge cases preceding the new rent law, as well as many concerning the J-51 tax break. The court ruled in landlord’s favor and should prove helpful to lawsuits challenging the Housing Stability and Tenant Protection Act of 2019.
