The new eviction ban passed by state lawmakers and signed by the Governor poses yet another challenge for Owners with rent-owing tenants. Legislation previously only required tenants to declare hardship. However, it is now rewritten to provide landlords the opportunity to go to court and challenge a tenant’s declaration of hardship. Sherwin Belkin warns that unless the tenant is obligated to provide evidence of the hardship, there is no due process. Mr. Belkin questions whether the latest bill will hold-up before the Supreme Court.
