Mark N. Antar is a Partner in the Firm’s Litigation Department and concentrates his practice in real estate and commercial litigation, with a focus on complex landlord-tenant litigation.

Mark represents clients in a broad range of trial and appellate matters in New York state and federal courts, including commercial and residential lease disputes, real estate purchase and sale litigation, Article 78 proceedings, FHA and ADA discrimination claims, condominium and cooperative governance disputes, contested access agreements, and construction and contract litigation.

Mark is a particularly accomplished courtroom advocate who has successfully tried numerous jury and bench trials to verdict, and argued and won multiple appeals before the Appellate Division and Appellate Term of the State of New York.

Representative Matters

  • Won trial in New York Supreme Court on behalf of a building owner in a commercial plenary action against a popular (but defaulting) sushi restaurant tenant, securing more than $400,000 in arrears and $50,000 in attorneys’ fees while defeating defenses based on alleged building defects and water leaks;
  • Obtained summary judgment in federal district court dismissing FHA and ADA discrimination claims brought by a rent-stabilized tenant against a management company and individual property managers.  The court (Hon. Ronnie Abrams) held that while landlords may be required to relocate a tenant as a reasonable accommodation in certain circumstances, “landlords are under no obligation to subsidize a disabled individual’s rent or to provide economic assistance in offering a reasonable accommodation under the FHA”;
  • Won a multi-day trial in New York Supreme Court securing rescission of a fraudulent stock purchase agreement, resulting in the return of a $250,000 down payment and cancellation of a $1.25 million promissory note;
  • Secured summary judgment for a condominium board in New York Supreme Court following extensive oral argument and briefing, establishing unit owner’s liability for charges and attorneys’ fees resulting from disruptive tenants;
  • Won summary judgment for a commercial landlord against a Bryant Park-area restaurant tenant, securing more than $1 million in arrears, possession of the premises, and attorneys’ fees;
  • Prevailed in the Appellate Division, First Department, affirming summary judgment for a commercial landlord, awarding $500,000 in damages, and dismissing defendant’s claims of forgery and fraud;
  • Prevailed in the Appellate Term, First Department, affirming a judgment of possession and enforcement of a commercial lease termination based on a conditional limitation for nonpayment of rent.
